Nanso lawyers threaten NYC with court action
2015-07-02Staff Report 2 Windhoek The Namibia National Students Organisation (Nanso) will seek a court intervention that seeks to compel the National Youth Council (NYC) to reverse its decision to suspend the student movement. This is contained in a legal document authored by Sisa Namandje and Co. Incorporated, the legal firm handling Nanso’s application. The letter is addressed to NYC representative council chairperson Neville Itope and executive chairman Mandela Kapere.Both Itope and Kapere were not available for comment yesterday. Nanso secretary general Dimbulukeni Nauyoma yesterday refused to comment, saying the matter is being dealt with by the movement’s legal team. Delegates at the just-ended extraordinary representative council meeting held in Nkurenkuru last weekend unanimously resolved to temporarily suspend Nanso from attending statutory NYC meetings until it sorts out its internal differences relating to purported internal factionalism. “We are under strict instructions to approach the High Court of Namibia to review and set aside your decision on the basis that it is procedurally defective and is muddied by various non-compliances with the principles of legality should the said decision not be reversed within a period of two days,” reads the letter. Nanso’s legal team claims that last weekend’s representative council meeting held in Nkurenkuru was not properly constituted, hence the decision to suspend Nanso is invalid. The legal team also demanded that NYC provide a full record of proceedings, minutes and supporting documents of last weekend’s meeting. NYC has been given until tomorrow to respond. “Should our client not receive such a response within a period of two days, we will assume that the said records of proceedings do not exist and our clients will proceed to arrange and tailor their affairs accordingly,” reads the letter further on. The NYC meeting established a committee led by John Kantana, which has been given the mandate to help Nanso sort out its internal affairs. Nanso had two representatives at last weekend’s extraordinary congress held in Kavango West, although they were only supposed to send one representative. Both its former secretary general Sharonice Busch and incumbent secretary general Dimbulukeni Nauyoma were present at the meeting. Nauyoma was elected to serve as secretary general of Nanso earlier this year, succeeding Busch. Nanso president Wilhelm Wilhelm on Sunday told this publication that Nanso delegated Nauyoma to represent the movement - not Busch. In fact, according to the representative council’s attendance confirmation list in New Era’s possession, Busch attended the meeting in her capacity as the national coordinator of an organisation called Aitsama Huisen. The representative council is the second highest decision-making body of the NYC and it has the power to suspend or reprimand any NYC members or affiliate organisations. NYC is in the process of restructuring all regional youth forums, with the first regional conference set to take place in Omaheke and Hardap regions this coming Saturday. Regional conferences for Karas and Zambezi regions are slated for the second weekend of this month. The suspension of Nanso effectively means that thousands of students across the country will have no say when it comes to electing a new leadership for the NYC. 2015-07-02Staff Report 2
