WINDHOEK – At 92, Jesaja Ewald Katjivikua is probably one of the oldest men to sue for divorce. Katjivikua wants to divorce his wife, Theopoldine Katjivikua (born Uaseta).

The matter was in the High Court last week before Acting Judge Hosea Angula. Theopoldine Katjivikua has until January 5 to restore conjugal rights, or a final order will be given when the two contending parties return to court on February 2 2015.

The two were married on June 13, 1984 and have seven children.

In court papers Katjivikua says his wife failed to communicate meaningfully with him. He further charges she emotionally abused him.

New Era could not establish the age of Thepoldine Katjivikua, but she is believed to be 30 years his junior.

Katjivikua further states he was “frequently denied love, affection, intimacy and marital privileges” and that his wife showed no serious intention to continue with the marriage.

Theopoldine Katjivikua allegedly informed her husband some of their children born in marriage are not his and he should stop contacting or visiting them. She allegedly also stole from her husband.

Meanwhile the two parties have agreed that Katjivikua will proceed with the divorce proceedings unopposed.

Court papers show the two agreed that the immovable property on Farm Vredehof No. 739 in Gobabis will be divided in equal portions and Theopoldine Katjivikua will keep the portion on which the main dwelling is situated and Katjivikua will get the other half.

The cost of dividing the farm will be borne by the parties equally. Theopoldine Katjivikua will keep the farm furniture and household appurtenances while Katjivikua will get the bedroom suite and three rifles, the Mercedes truck and the Land Cruiser.

The couple’s two shops in Gobabis will be sold and the proceedings divided in equal shares between the two. Their livestock will be divided equally among the couple whose differences seem irreconcilable.
