A co-accused in the case of two counts of attempted murder and illegal possession of ammunition and a firearm did not appear in court last week for unknown reasons, which hindered passing of judgement.
Jafet Kenedy Haikela, 29, is charged with illegal possession of ammunition and a firearm, along with his co-accused, Lineekela Bonga Matias, 34. Matias stands accused of attempted murder, read with the Domestic Violence Act of 2003. It is alleged that on February 5 he attempted to end Martha Amwedi’s life in Rundu Street in Havana, Windhoek. Matias reportedly fired four bullets with a pistol in Amwedi’s direction, with the aim of killing her.
According to the charge sheet, Matias also assaulted Usko Mwandingi by firing in his direction the following day. It is alleged the accused on February 6 tried to end the life of Mwandingi. He allegedly fired a gun in the direction of Mwandingi with the intention to kill him. The incident also happened near Rundu Street, Havana.
On both counts it is not clear what caused Matias to fire gunshots in an attempt to end both Amwedi and Mwandingi’s lives.
It is alleged the firearm used on both occassions belonged to Jafet Kenedy Haikela, is charged with illegal possession of ammunition and a firearm. It is alleged Haikela was in possession of a firearm with five live rounds without a legal licence, that would permit him to possess such a firearm.
Haikela allegedly gave the black 9mm pistol to Matias, who used it in the case of attempted murder, but he did not show up in court last week.
Magistrate Kesslau Erich Edward then issued a warrant of arrest for Haikela, so that judgement can be passed. Edward postponed the case to December 7 in the hope Haikela will be found. He warned Matias that if he fails to appear in court, like his co-accused Haikela, a warrant of arrest will be issued against him.
Matias was released on bail of N$1 000. He is yet to know his legal fate. If found guilty, the two accused may face five years in prison each or be liable to a fine of N$12 000 dollars.
