WINDHOEK – The bail hearing of Erastus Heita, who stands accused of gunning down his live-in girlfriend in their shared flat in Otjomuise late last year, is expected to resume in September.
Heita, 42, has been in court for the past week hoping to convince the court to release him on bail while awaiting trial. He pleaded not guilty to the charge of murder read with the Provisions of Domestic Violence Act. The charge emanates from the death of his girlfriend of nine years Maria Megameno Kamati, 29. Kamati was shot in the head on October 01, 2017 in Otjomuise, Windhoek.
During his bail hearing in Katutura Magistrate’s Court, Heita testified that Kamati’s death was an accidental one. He explained that Kamati, 29, was accidentally shot after he was trying to shoot an intruder who emerged from their bedroom wardrobe that early morning.
“I would like to apologise to the family. I know it is difficult to accept what has happened but it was not my intention. I too lost someone I loved. I humbly ask that they accept my apologies. I am still their son,” noted Heita from the witness stand.
Further stating that Kamati’s passing has traumatised him and the only way he could overcome the tragedy was to hand himself over to God.
“I have given my life over to the lord to help me accept what has happened,” said Heita. The accused has thus far according to him completed numerous biblical courses during his ongoing incarceration.
The father of four is pleading with the court to release him on bail, citing that his children need him as he was their provider. He explained that their lifestyle has changed and his incarceration has affected their school performance. Heita informed the court that he can afford bail in the range of N$5000 and N$10 000.
During the hearing, it was revealed that the couple previously argued to a point where Heita’s personal firearm was confiscated by the police, but was later returned to him in January 2017.
The prosecution strongly opposes the release of Heita on bail on grounds that the offence he is facing is of a serious nature and there is fear that he will abscond and not stand trial. Furthermore, it will not be in the interest of the public nor administration of justice.
Heita is being represented by defence attorney Kadhila Amoomo with Arie Husselman prosecuting for the State.
