Magistrate Kavara could face interdict on FB postings

Windhoek

The Magistrates Commission wants to stop suspended magistrate Hileni Kavara from making comments on her Facebook profile about other magistrates and the commission.

Kavara’s ex-fiancé and father of her child, Mahammed Shabani, was nabbed for possession of cannabis valued at N$200 000 last year.
Shabani has been a fugitive since late last year when he missed a court appearance. He was out on N$50 000 bail that Kavara paid. It is also said that it was the bail money that got Kavara suspended when she tried to have the court return the money to her instead of the money being forfeited to the state.

A letter addressed to Kavara by the Magistrates Commission dated February 26 reads: “Please be informed that the Magistrates Commission took notice of your comments on social media concerning certain magistrates, the Magistrates Commission and the magistracy. You are directed to refrain from posting such comments. Failure to do so will result in the Magistrates Commission obtaining an interdict against you.”

Kavara posted a copy of the letter on her Facebook profile and said: “Magistrates Commission, go ahead and obtain an interdict against me – what I post on my Facebook page has nothing to do with you! Clearly , you have nothing better to do with your time! ‪#‎Psalms‬ 37 and 39. ‪#‎MagistratesCommissionMustFall‬#”

Kavara accused the prosecutor general Martha Imalwa of prejudice and practising double standards after the latter allegedly successfully recommended Kavara’s suspension over allegations of corruption, while she herself reportedly declined to prosecute her son, Benjamin Imalwa, who was accused of rape.

Kavara was stationed at the Windhoek Magistrate’s Court, then Katutura Magistrate’s Court. Magistrate Jermaine Muchali has since been moved to the Katutura Magistrate’s Court after Kavara was suspended.
