RUNDU – Former Nkurenkuru constituency councillor Damian Nakambare, who was last week denied bail by the prosecution on grounds that he has demonstrated a propensity to commit similar crimes, was yesterday granted bail of N$5 000 during a formal bail application in the Rundu Magistrate’s Court.
Nakambare who was charged with attempted murder and contravening Section 38 of the Arms and Ammunition Act, Act 7 of 1996, discharging a firearm in a public place, is represented by Bernhard Tjatjara.
Nakambare’s bail conditions are; he must surrender his three licensed firearms to the investigating officer. He must also not interfere with the investigation or witnesses as well as not commit similar offences while on bail pending finalisation of the matter.
The court also ordered that he reports himself once a week, on Fridays between 08h00 and 17h00 to the investigating officer at Kahenge.
The accused former councillor appeared before Rundu magistrate Murray Shikongo while public prosecutor Godfry Shivolo represented the State.
Last week, the prosecution revealed Nakambare had a pending case of attempted murder in which he was previously granted bail in the same court, and he had another case of theft before the Rundu Magistrate’s Court and that made the prosecution to deny him bail.
The Kavango West police arrested Nakambare on Sunday, a week ago, at Mayara village when he allegedly shot and wounded his 42-year-old relative after an intense argument.
He allegedly shot the victim in the presence of the police, who were attending to his complaint, which he brought to their attention regarding his nephew, who refused to give him his car keys.
While the police were trying to separate them, he pulled out his gun and shot at the victim, who is being treated in the Nankudu district hospital.
According to the police, it is alleged the suspect shot the victim with a nine-millimetre pistol in the lower abdomen.
The matter is postponed to 12 December 2022 for further police investigations.
