Magistrate Esme Molefe has extended the period of remand for the accused in the Namcor N$400 million fraud and conspiracy case.
The Magistrate made a ruling whereby she granted the State’s request to postpone the matter to next year, yesterday in the Windhoek Magistrate’s Court.
The accused in the matter are expected to spend a further four months in custody until 19 March 2026, when they will be expected to make another court appearance.
They were arrested in July 2025 on suspicion of corruption, theft, conspiracy and various other charges under the Prevention of Organised Crime Act and the Anti- Corruption Act.
Last Friday, State advocate Basson Lilungwe had requested the court to grant the State a further postponement in the matter until all investigations are completed and finalised.
The accused, with their lawyer’s speaking on their behalf, had opposed the application stating that they will be prejudiced and had requested for the matter to be removed from the roll.
Magistrate Molefe, in her ruling yesterday, stated that in terms of the Criminal Procedure Act and case law, an adjournment in a criminal matter is not to for a mere asking.
Molofe said that it must be motivated in terms of the Criminal Procedure Act and on the grounds that it would be necessary for execution to do so.
Molefe stated the court weighed up that the accused would suffer against the prejudice that the State would suffer if the application is granted or not.
She also looked at the history of the matter including various bail applications that were lodged since the matter has been before the court.
“I am therefore persuaded to grant the application by the State for postponement and in accordance the request is granted,” she ordered.
The matter was postponed to 19 March 2026 for further investigations.
The accused in the matter are Immanuel Mulunga, Cedric Willemse, Jennifer Hamukwaya, Olivia Dunaiski, Peter Elindi, Malakia Elindi, Lydia Elindi, Panduleni Hamukwaya, Leo Stefanus Nandago, Austin Elindi and Connie van Wyk.
