A teenage boy, who was arrested in March 2021 for allegedly assaulting and sexually violating a four-year-old girl, will take the stand next year to answer to the allegations. The prosecutor general has decided to arraign the 15-year-old boy with a charge of rape and another count of assault. Furthermore, he must be tried in the Windhoek Regional Court.
It is alleged that the complainant, who at the time of the incident was four years old (currently five), was left at home with the alleged perpetrator, who was 14 years old at the time. The two are cousins.
The State is alleging that on 25 May 2021, while the two were home alone in Monte Cristo, Katutura, Windhoek, the teenager sexually violated the minor.
It is alleged the accused, who is a grade eight learner at a local school in Windhoek, used physical force by assaulting the minor victim with his fists to coerce the minor.
While appearing in the Regional Court yesterday before magistrate Justine Asino, the alleged perpetrator was informed the court has made 27 January 2023 and 2 to 3 February 2023 available to hear his matter.
This is because the minor complainant is not ready to take the stand. Furthermore, her social worker, who will accompany her in the witness box, is currently on leave.
The court postponed the matter to 27 January, releasing the alleged perpetrator in the care of his father. The guardian was warned that failure to bring the accused to court, a warrant of arrest will be issued for him. The accused is represented by Julian Kavejandja, while Menencia Hinda is prosecuting for the State.
