WINDHOEK – A case in which two men from Windhoek are accused of fraud for allegedly selling a house illegally has been sent to the Prosecutor General for a decision.

Laurence Maanda and Danville Beukes both pleaded not guilty in terms of Section 119 of the Criminal Procedure Act before Magistrate Justine Asino on Monday. It is alleged that during the period March  to May 2012 Maanda acting as the estate agent and Beukes acting as the owner of Erf 3671, Extension 3, Khomasdal, Windhoek with intention to defraud told Fauster Claasen that the house in question was for sale for N$850 000. Claasen was allegedly duped into entering into a sales contract with Maanda and paid an amount of N$711 000 to effect the transfer of the house. It is further alleged that they knew that there was an attachment on the house and that the money received from Claasen was supposed to be paid to Hartlief, but instead used the funds for their own use and thus committed the offence of fraud.

Maanda through his lawyer Kalundu Kamwi from Sibeya and Partners Inc. pleaded not guilty to the charges and chose not to disclose his defence and to remain silent. Beukes through his lawyer, Milton Engelbrecht from Diederick Law Firm also entered a plea of not guilty and challenged the State to prove every element of the charge against him. The case was then postponed to 22 October for the PG’s decision.
