Biko attacks DNA in rape trial

Lawyer Rudi van Vuuren, who took over the defence of Steve Biko Booys, started his defence by attacking the chain of custody of the DNA analysis for the rape kit.

When the trial resumed on Tuesday last week, Van Vuuren immediately went for the jugular, first questioning the credentials of the laboratory technician who did the analysis. 

He then questioned whether the samples were kept in a safe space and if the samples were free from contamination. 

The technician, Foibe Iita, was adamant that the samples were kept in the strong room at the National Police Forensic Science Institute at room temperature as per international regulations. 

She stated that when she withdrew the samples from the strong room, it was in her custody until she finished with her analysis. 

She was adamant that no tampering had taken place on the samples. 

Two samples were taken from the alleged victim, and one reference sample from Booys. 

He is on trial for allegedly raping his biological daughter. 

It is alleged by the State that he raped the complainant twice during January 2021 at his house in Okahandja. 

He has remained in custody since handing himself over to the police despite several failed attempts to be released on bail. During her testimony, the complainant testified that Booys plied her with alcoholic drinks and had intercourse with her while she was incapacitated. 

Booys has denied the allegations. 

The former councillor faces four charges, two counts of rape and incest. 

The State is alleging Booys raped the then 20-year-old woman at Okahandja on 16 and 17 January 2021. 

Booys is currently being detained at the Seeis police station. 

Regional Magistrate Esme Molefe postponed the matter to 15 September for the continuation of the trial.
