WINDHOEK – Katutura Magistrate’s Court provisionally withdrew a case of murder against a Windhoek resident who stood accused of killing Johannes Jetta in 2016.
Desmond Amgabeb faced a charge of murder for allegedly intentionally stabbing Jetta to death. Jetta died from a stab wound after he was allegedly stabbed with an Okapi knife near Greenmountain road, Goreangab Dam on December 31, 2016.
Yesterday, Amgabeb walked out of court a free man, after Magistrate Ndjavera Uakotora granted the State’s request to withdraw the case against him.
According to State prosecutor Ellen Shipena, the decision from the Prosecutor General (PG) was not available thus the withdrawal. The case was on the court roll for the Prosecutor General decision.
The PG had to decide whether or not to prosecute Amgabeb, decided the charges and whether the case would be transferred to another court.
Amgabeb who was on bail of N$3000 was refunded his money.
During previous court proceedings, Amgabeb’s defence attorney Moses Tjituri had asked the court to provisionally withdraw the case against Amgabeb.
Tjituri at the time voiced his frustration with the court. Tjituri reminded the state that the matter at hand is of a serious nature and should be treated as such.
He proposed the matter be struck from the court’s roll and once the PG’s decision is ready then the accused can be summoned.
The case was postponed several times for the PG and during the last court proceedings in May, the prosecution informed the court that the docket was not sent to the Prosecutor General’s office for decision. At the time, Magistrate Michelle Kubersky noted it has become habitual for the state to submit dockets for PG’s decision which delayed cases from going to trial.
