Judgement was granted last week Friday in a case between Oryx Properties Limited, the owner of Baines Shopping Centre, and Fama Sisters Investments CC, trading as Eagles Pizza.
In this judgement, immediate eviction of Fama Sisters from Baines Shopping Centre was ordered, as well as the payment to Oryx Properties Limited by Fama Sisters of rental and other charges outstanding, as well as holding over damages and costs pertaining to this action in the High Court of Namibia.
Ben Jooste, CEO of Oryx Properties, said, “After a protracted and costly legal process, we are grateful that justice has been served in this case. I would like to thank the legal team involved, as well as the Oryx employees who assisted in supporting them. We are now able to proceed with the exciting plans we have for Baines Shopping Centre”.
Oryx further refuted claims published in media in recent weeks, alleging that it concluded more than one lease agreement for the shop in question.
“All stakeholders are hereby assured that due process was followed and a valid lease agreement was concluded with Fama Sisters Investments CC, which formed the basis on which the above-mentioned judgement was arrived at by the High Court of Namibia,” read an Oryx Properties statement.
Oryx also informed the public that Eagles Pizza at Baines Shopping Centre will be closed from 24 November 2024, and that announcements regarding plans for the centre will be made in due course.
