Lawyer Olivier abandons Booys

Marthino Olivier, the privately- instructed lawyer of Steve Biko Booys withdrew from the trial on Monday. 

Booys confirmed this development with magistrate Esme Molefe during a scheduled court appearance. 

Prosecutor Emma Mayavero informed the court that she received a phone call from Olivier, in which he informed her of his withdrawal and that he will send through a letter explaining the reasons for his withdrawal. 

Booys informed the magistrate that he will instruct a new lawyer, but that he will need time to find a lawyer and consult with him. 

The magistrate agreed to a postponement to 30 October but warned the accused that he will have to get a lawyer soonest, as the case has been dragging on for quite some time. 

The matter is currently on hold as Booys has instituted a special review on some aspects of the trial so far. The review is pending in the High Court. 

He is on trial for allegedly raping his biological daughter. It is alleged by the State that he raped the complainant twice during January 2021 at his house in Okahandja. 

He remained in custody since he handed himself over to the police after several failed attempts to be released on bail. During her testimony, the complainant testified that Booys plied her with alcoholic drinks and had intercourse with her while she was incapacitated. He denies the allegations. 

The former councillor is facing four charges, two counts of rape and incest. 

The State is alleging Booys raped the then 20-year-old woman at Okahandja on 16 and 17 January 2021. 

He is currently being detained at the Seeis police station.
