Man arraigned for ‘rape’ of niece

A Lüderitz resident, accused of raping his niece, pleaded not guilty to a charge of rape in the High Court yesterday before Judge Eileen Rakow.

The man, who cannot be identified to protect the identity of his alleged victim, did not provide a plea explanation. He put the onus on the State to prove each and every allegation against him. 

His Legal Aid appointed lawyer Eva-Maria Nangolo informed the court that the plea is in line with her instructions.

She said her client will make use of his right to remain silent and not disclose the basis of his defence.  It is alleged by the State that, on a date unknown but during the period 2020 to October 2021, the accused committed a sexual act with the child. The victim was eight years old at the time.  The accused is married to the complainant’s aunt and resided in the same residence as the complainant and mother.  It is further alleged by the State that between the year 2019 and October 2021, when the complainant was only six years old, the accused committed several and numerous sexual acts with her while threatening or assaulting her. 

The indictment states that the accused threatened by word or conduct to harm the victim, who was at that stage extremely vulnerable.  The accused is out on bail.
