The Windhoek High Court on Monday struck the appeal of a man convicted of strangling to death the elder sister of the mother of his three children in 2012, from the roll.
Judge Naomi Shivute granted the State’s request to have Gregorius Laurentius Kido’s application struck from the roll while he is sorting out his legal representation with the Directorate of Legal Aid as well as commissioning his documents.
Kido, 41, wanted the High Court to grant him leave to appeal his sentence in the Supreme Court.
In 2013, he was sentenced to 30 years in prison for the murder of Petrina Hendrina Isaak. He was further sentenced to six months in prison for the theft of Isaak’s cellphone, but this sentence was ordered to run concurrently with the murder sentence.
On the charge of assault with intent to cause grievous bodily harm and the assault by threat charge, he was sentenced to 12 months and three months, respectively, with the latter ordered to run concurrently with the former sentence.
Kido was convicted after he confessed to having strangled Isaak to death with his bare hands, after which he took her cellphone and a pair of sandals.
The evidence was that during the late-night hours of 31 January 2012 or the early morning hours of 1 February 2012 in Tseiblaagte, Keetmanshoop, Isaak was on her way home on foot when Kido pounced on her.
Isaak died on the scene due to manual strangulation.
It was further stated that Kido believed Isaak was to blame for his ex-girlfriend ending their intimate relationship, and/or causing her to apply for a protection order from the police against him.
