A trial has remained at a standstill pending a revised psychiatric evaluation report, as the accused insists that proceedings should not continue until full disclosure has been provided to him.
Making an appearance yesterday during a pre-trial conference, Theodor Shipanga told Deputy Judge President Hannelie Prinsloo that his trial is one without charges.
Shipanga told the court that he is standing trial without knowing what he is charged for, and that there is no case registered at the police station. He said he has not received the docket from the State comprising his warning statement, the charge sheet, the post-mortem report, witness statements and scene of crime.
The accused said he only received an affidavit or statement made by his arresting officer but not his warning statement. He added that he has also not received full disclosure of the brown file, a file that contains the full investigation record held by the police.
The State represented by Anna Amukugo stated that the accused has received and is in the possession of a full disclosure. However, the accused was adamant he was not, even adding that his crime registration number or the CR number, is wrong.
He added that he was arrested in 2011 – and up to today, he is not aware of the allegations against him and claims they are false allegations.
He explained that various people, two judges, a lawyer and legal aid told him he has no case against him.
The accused has sung this tune since last year when his matter was postponed numerous times before Judge Claudia Claasen, saying that he had not fully disclosed the docket. He has also stated that there is no case registered with the police against him and that he is in court against his constitutional rights.
The case was then placed on the case management roll to assign a trial judge after Judge Claasen recused herself upon being privy to information she should not have been exposed to.
The matter was postponed to 18 March 2026.
